Investigación y docencia en derecho constitucional: apuntes y materiales para la comprensión de un constitucionalismo inclusivo

Abstract

El presente trabajo recoge la experiencia en docencia e investigación desde una perspectiva crítica en derecho constitucional, en concreto, en el análisis histórico de las cartas de derechos de las constituciones, de sus protagonistas y de los grupos excluidos en la etapa de la construcción de los derechos. Comprende el estudio histórico de los derechos fundamentales, destacando la problemática de la desigualdad entre mujeres y hombres presente en los orígenes del constitucionalismo, y los planteamientos que entonces se hicieron para darle una mayor dimensión a la idea de igualdad. La temática se centra en la historia del constitucionalismo estadounidense y francés. Se pone mayor énfasis en la historia del constitucionalismo estadounidense y, por lo tanto, se incluyen materiales elaborados para la docencia. Se trata de Timelines o esquemas cronológicos sumarios; la traducción al español de un documento político importante en la historia del constitucionalismo: la Declaración de Sentimientos (Seneca Falls) de 1848 y el cuadro comparativo sumario entre las Declaraciones de 1776 y de 1848.

This work reflects the experience of teaching and investigating Constitutional Law from a critical perspective and, specifically, in the historical analysis of the bills of Rights of the Constitutions, their protagonists and the groups that were excluded during the time when rights were constructed. It encompasses the study of the history of fundamental rights, underlining the inequality of women and men as present at the beginning of constitutionalism, and the proposals of that time for giving a greater dimension to the idea of equality. The subject centers on the history of North-American and French constitutionalism. More emphasis is given to North-American history and, for that matter, guides for teaching are included. These take the form of timelines or chronological summaries, and come with a new translation to Spanish of a political document of importance in the history of constitutionalism: the Declaration of Sentiments (Seneca Falls) of 1848, as well as a summary schematic comparing the Declarations of 1776 and of 1848.
