Abstract: | El artículo tiene como objetivo explicar el proceso de reforma de los derechos de autor que se está llevando a cabo en la Unión Europea con el fin de alcanzar el objetivo de crear un mercado único digital. Los mecanismos que propone la Comisión Europea para ello son específicos de un proceso de integración como la Unión Europea e incluyen: el binomio principio de control en origen-reconocimiento mutuo, los mecanismos para luchar contra la compartimentalización del mercado interno, y la profundización en la armonización de las legislaciones nacionales de derechos de autor. Al hilo de estas explicaciones, también se revisa la reciente jurisprudencia del Tribunal de Justicia de la Unión Europea en la materia. | The objective of this paper is to explain the process to amend the copyright system that has been initiated by the European Union with the purpose of creating a Digital Single Market. The mechanisms that the European Commission proposes to achieve this objective are exclusive of an economic integration organization such as the European Union. They include the binomial country of origin-mutual recognition principles, the mechanisms to fight against the fragmentation of the Internal Market and the proposal to increase the harmonization in the Member States copyright legislations. Through the text, a review of the recent case law of the Court of Justice of European Union is also provided. |
