Abstract: | Este texto reproduce la lección pronunciada por el autor en la Universidad de San Marcos de Lima con ocasión de la concesión, junto con Luigi Ferrajoli, de un doctorado honoris causa por dicha universidad. En el apartado 1 se hace referencia a la relación entre la Universidad de San Marcos y el autor y a la importancia de la Universidad de San Marcos en la historia del Perú, a través de diversas citas literarias (Vargas Llosa, Bryce Echenique). Posteriormente (apdo. 2) se alude a la significación de la obra de Luigi Ferrajoli en el pensamiento jurídico contemporáneo, y en especial a sus propuestas de reformas institucionales. El apartado 3 constituye el núcleo de la lección y en él se exponen sintéticamente cuatro tensiones presentes en los sistemas jurídicos desarrollados: a) en primer lugar, la tensión entre la pretensión de autoridad de las normas jurídicas, y la pretensión de que las decisiones relativas a casos individuales sean correctas; b) en segundo lugar, la tensión entre principios distintos que resultan prima facie aplicables a un mismo caso; c) en tercer lugar, la tensión entre la conveniencia de atrincherar ciertos contenidos normativos y el principio mayoritario; d) en cuarto lugar, la tensión entre el establecimiento de autoridades definitivas y la pretensión de que esas autoridades estén vinculadas a determinados contenidos normativos que les preexisten. El texto concluye (apdo. 4) con algunas reflexiones relativas al status de la llamada “ciencia del derecho” o doctrina jurídica. | This text is a literal transcription of the lecture given by the author at the University of San Marcos in Lima on the occasion of a ceremony at which Luigi Ferrajoli and him were awarded an honorary doctorate. In its first paragraph the author writes on his own connection with the University of San Marcos as well as on the important role that this University played in the history of Peru; he resorts to various literary quotes (Vargas Llosa, Bryce Echenique) to illustrate the latter. Then, paragraph 2 is devoted to stress the significance of the work of Luigi Ferrajoli in contemporary legal thought, and particularly to his proposals for institutional reforms. Paragraph 3 reproduces the central ideas in the lecture. Concisely, the author gives an account of four tensions to be found at the very core of developed legal systems: a) first, the tension between the legal norms’ claim of authority, and the claim of correctness in decisions on individual cases; b) secondly, the tension between conflicting principles which are prima facie applicable to the same case; c) thirdly, the tension between the convenience of constitutionally entrenching certain normative content and the majority principle; d) fourthly, the tension between the existence of definitive authorities and the claim that these authorities are limited by certain pre-existing normative contents. The text concludes (paragraph 4) with some reflections on the status of “legal science” or legal doctrine. |
