L’estensione verticale del dominio di fronte alle nuove realtà: limiti e strumenti di tutela della proprietà. L’evoluzione della Trespass Doctrine e della Nuisance Law negli Stati Uniti

Abstract

Quando si parla tradizionalmente di estensione verticale della proprietà, si pensa ai limiti sopra e sotto il suolo, nonché al potere di escludere azioni esterne all'interno di tale ambiente. Con l'espansione dei sistemi aerei senza pilota nello spazio aereo, si apre un dibattito sulle conseguenze legali della loro accettabilità sociale. In considerazione del disturbo che può essere arrecato al godimento della proprietà privata, diventa necessario delimitare le interferenze consentite e quelle soggette a rivendicazioni legali. A tal fine, nel presente documento analizziamo i meccanismi di protezione, nel loro equilibrio con il dovere di sostenere la navigazione aerea. A tal fine, riportiamo l'evoluzione della dottrina dell'aerial trespass negli Stati Uniti, a seguito del caso United States v. Causby e i problemi di adattamento che esistono con il sorvolo di questo tipo di aeromobili.

Traditionally, when we speak of the vertical extension of property, we think of the boundaries above and below the ground, and the power to exclude external action within that environment. With the expansion of unmanned aircraft systems into the airspace, a debate about the legal consequences of their social acceptance is emerging. In view of the nuisance that may be caused to the enjoyment of private property, it becomes necessary to delimit the permissible interferences and those that may be the subject of legal claims for overflight. To this end, in this paper we analyze the mechanisms of protection in its balance with the duty to support air navigation. And with this objective, we bring up the evolution of the doctrine of aerial trespass in the United States, after the case United States vs. Causby, and the problems of adaptation that exist with the overflight of this type of aircraft.
