Las licencias de uso de bienes digitales: el difícil equilibrio entre los intereses de los titulares de los derechos y los usuarios

Abstract

Esse artigo aborda as normativas aplicáveis às licenças de uso de bens digitais. É possivel constatar dois interesses opostos, assim normatizados: Por um lado, as normas de propriedade intelectual favorecem os titulares dos direitos em prejuízo da comunidade em geral e dos usuários em particular; por outro lado, a norma sobre condições gerais da contratação e, principalmente, a proteção dos consumidores favorecem os intereses dos usuários de direitos. Assim, busca-se definir um equilibrio entre esses interesses, tendo em vista a natureza inovadora dos bens digitais.

This article approaches normative the applicable ones to the licenses of use of digital goods. He is possivel to evidence two opposing interests, thus normatizados: On the other hand, the norms of copyright in general favor the bearers of the rights in damage of the community and the users in particular; on the other hand, the norm on general conditions of the act of contract and, mainly, the protection of the consumers favor the interests of the users of rights. Thus, one searchs to to define a balance between these interests, in view of the innovative nature of the digital goods.
