El reconocimiento estatal del matrimonio religioso contraído al amparo del artículo 60.2 del Código Civil

Abstract

Este trabajo analiza el régimen jurídico del matrimonio celebrado en el seno de confesiones religiosas con notorio arraigo, al amparo del art. 60.2 del Código Civil, tras su modificación por la Ley de Jurisdicción Voluntaria 15/2015. Se estudian, entre otras cuestiones, la posible eficacia civil de aquellos matrimonios celebrados sin cumplir los requisitos exigidos estatalmente, así como si es factible contraer nupcias religiosas únicamente a efectos intraconfesionales.

This paper analyses the legal regime of marriage celebrated by those religious communities that have obtained a recognition of well-known roots, under the Article 60.2 of the Civil Code spanish jurisdiction, after its modification by Law 15/2015, of Voluntary Jurisdiction. Also, this work deals, among other issues, the possible civil efficacy in Spain of those marriages celebrated without the civil requirements demanded by the State, as well as if it is possible to marry only with intra-confessional effects.
