| This paper aims to make an interpretative proposal that covers the existing legal gap in the matter of transfer and re-use of technology when the technology transfer agreement regulates the continued use and all of the same by the Administrations. Neither Spanish legislation nor Directive 24/2014 resolve this problematic issue. The objective of this work will be to analyze the regulations and jurisprudence, specially the Spanish Constitutional Court STC 55/2018 and the Judgement «C-796/18» of the Court of Justice of the European Union «Informatikgesellschaft für Software-Entwicklung,» to provide solutions to resolve the insufficient legal framework of the technology transfer. |
