Analysis of the case "Obligations concerning negotiations relating to the cessation of the Nuclear Arms Race and to Nuclear Disarmament" (Marshall Islands v. Pakistan, India and United Kingdom)

Abstract

The cessation of the nuclear arms race and nuclear disarmament are vitally important objectives for the international community as a whole, and the Republic of the Marshall Islands is particularly sensitive to the catastrophic consequences that nuclear weapons can have on the humankind because they have experienced them at first hand in the past. We all want a future free of nuclear weapons for our generation and the subsequent ones, with the Nuclear Non-Proliferation Treaty it seems that it is not enough. This has been demonstrated with Marshall Islands case in the International Court of Justice. What does the future hold? Is the Treaty on the Prohibition of Nuclear Weapons the solution?
