Abstract: | El Comité Europeo de Derechos sociales ha emitido sus Conclusiones XX-3 (2014) relativas al cumplimiento de los derechos laborales la Carta Social Europea por parte de España durante el período 2009-2012. En fechas coincidentes, el Tribunal Constitucional se ha pronunciado sobre una Cuestión y dos Recursos de Inconstitucionalidad planteados frente a la reforma laboral. La confrontación y análisis conjunto de las Conclusiones del Comité Europeo de Derechos Sociales y los pronunciamientos del Tribunal Constitucional permite observar cómo varios de los preceptos de la reforma laboral que el Tribunal Constitucional considera acordes con la Carta Magna son calificados, al mismo tiempo, como vulneradores de los compromisos internacionales asumidos por el Gobierno de España al ratificar la Carta Social Europea. En el presente estudio se realizará un análisis comparado de las materias que han sido objeto de juicio en los mismos, además de aquellas únicamente afrontadas por el Comité, al objeto de obtener una visión global de la reforma laboral a la luz de la Carta Social Europea, alcanzar conclusiones sobre el grado de cumplimiento de los compromisos en materia laboral derivados de la misma por parte de España, el papel que los pronunciamientos del órgano encargado de su aplicación e interpretación debe desempeñar en las resoluciones adoptadas por órganos judiciales internos y las divergencias entre Tribunal Constitucional y Comité Europeo de Derechos Sociales a propósito de la reforma laboral. | The European Committee of Social Rights has issued its conclusions XX-3 (2014) concerning the enforcement of labor rights the European Social Charter by Spain in 2009-2012. In the same dates, the Constitutional Court has ruled on a question and two Unconstitutional Resources raised against labor reform. Confrontation of all the conclusions of the European Committee of Social Rights and the rulings of the Constitutional Court analysis allows observe how many of the precepts of labor reform that the Constitutional Court considers consistent with the Constitution are rated at the same time as incompatible international commitments made by the Government of Spain by ratifying the European Social Charter. In the present study a comparative analysis of subjects who have undergone the same trial be held in addition to those faced by the Committee only in order to obtain an overview of the labor reform in the light of the European Social Charter, reaching conclusions about the degree of implementation of commitments on labor derived therefrom by Spain, the role that the pronouncements of the Comitee responsible for their application and interpretation should play in the resolutions adopted by domestic courts and the differences between Constitutional Court and the European Committee of Social Rights concerning labor reform. |
