| The article 156 bis of the Penal Code, punishing the trafficking in human organs, raises several problems, especially those related with the determination of the interest called to be protected as well as the interpretation of the criminal behaviors themselves. The study of these two problems constitutes the main objective of this paper. Furthermore, it deals with the most important differences between the Spanish' regulation against trafficking in human organs as compared to similar regulations in other legal systems on the one hand and, on the other hand, it investigates whether this crime is distinguishable from the human trafficking with the purpose of the removal of organs (art. 177 bis.1.c PC). |
