Abstract: | El estallido del escándalo Dieselgate en el año 2015 resultó en el inicio de acciones legales por todo el mundo para indemnizar el daño causado a los consumidores afectados. Concretamente, en la UE, el alcance de estas acciones ha sido limitado, produciendo efectos únicamente dentro del territorio de los correspondientes Estados miembros. Esto se debe a la dificultad de articular una acción colectiva a escala europea a tenor de los instrumentos legales disponibles hasta la fecha. La habilitación de un nuevo mecanismo procesal en la ley neerlandesa ha llevado a la DEJF, una asociación con sede en Países Bajos, a emprender una acción colectiva en representación de consumidores de varios países europeos. La demanda interpuesta genera una serie de interrogantes que ponen de manifiesto la necesidad de adaptar los criterios empleados por los instrumentos de Derecho internacional privado para garantizar un despliegue eficaz del modelo europeo de tutela colectiva. | The outbreak of the Dieselgate scandal in 2015 resulted in the initiation of legal actions around the world to compensate the damage caused to affected consumers. Specifically, in the EU, the scope of these actions has been limited, producing effects only within the territory of the corresponding Member States. This is due to the difficulty of articulating a Europe-wide collective action on the basis of the legal instruments available to date. The introduction of a new procedural mechanism in Dutch law has led the DEJF, an association based in the Netherlands, to bring a collective action on behalf of consumers from several European countries. The action raises a series of questions that highlight the need to adapt the criteria used by the instruments of private international law in order to guarantee an effective deployment of the European model of collective protection. |
