Sexual violence with reference to the forthcoming Law for the Guarantee of Sexual Freedom in Spain

Abstract

The article reviews the criminal offenses in matters of sexual freedom in Spain in line with the latest jurisprudence of the Supreme Court and the legislative project currently being debated in Parliament. The general objective is to reflect on the importance of incorporating feminist legal theories in legal discourse, especially if what is sought is the normative effectiveness of the laws that try to eradicate sexual violence. It is a qualitative analysis from the methodological point of view where the postulates of the antidiscrimination law are important. It ends with a series of recommendations to the legislator to be taken into account in the current parliamentary discussion.
