Abstract: 
El presente trabajo establece la necesaria aplicación de la teoría general de la responsabilidad administrativa ante actuaciones y resoluciones de la Administración, organismos y entidades del sector público mediante sistemas de Inteligencia Artificial que generen daños. Para ello se determinarán los elementos que configuran la aplicación de la técnica de la responsabilidad y los supuestos más característicos de uso de la IA por las Administraciones.
This paper establishes the necessary application of the general theory of administrative liability in the face of actions and resolutions of the Administration, bodies and entities of the public sector by means of Artificial Intelligence systems that generate damage. To this end, the paper will be determined the elements that make up the application of the liability technique and the most characteristic cases of the use of AI by administrations.
