Abstract: 
Se presenta un comentario al capítulo IV de Positivismo jurídico «interno» de María Cristina Redondo, ofreciendo una reformulación de la tesis interpretativista que la autora expone y critica, y se responden las críticas a La forma del derecho de Fernando Atria desde un punto de vista «institucionalista», mostrando las ventajas de adoptar dicha posición teórica para ampliar el alcance de la teoría del derecho hacia las teorías especiales del derecho.
The commentary focuses on chapter IV of Positivismo jurídico «interno» by María Cristina Redondo. It offers a reformulation of the interpretive thesis that the author exposes and criticizes, and it answers the criticisms of Fernando Atria’s La forma del Derecho from an «institutionalist» point of view. Finally, it shows the advantages of adopting such a theoretical position to broaden the scope of legal theory towards special theories of law.
