Resumen: Circunstancia que debe destacarse de la institución del defensor judicial es el gran desarrollo normativo experimentado en cuanto a su ámbito de actuación. Su originario marco de actuación, restringido a la patria potestad, se vio ampliado por Ley 13/1983 de 24 de octubre, de reforma del Código Civil, a los regímenes de tutela y curatela. Dicha regulación ha resultado inalterada hasta la Ley 15/2015, de 2 de julio, de Jurisdicción voluntaria, provocando con su aprobación, al tiempo que sustanciales incidencias en el funcionamiento de la institución, ciertas disfunciones con el marco normativo que proporciona, a su vez, el Código Civil. Respecto a su praxis se analizan, en relación con el supuesto de actuación por conflicto de intereses, las parcelas donde este supuesto suele prodigarse, con la finalidad de obtener los correspondientes criterios de actuación seguidos por el Tribunal Supremo y la Dirección General de los Registros y del Notariado. Destacan a este último respecto los conflictos generados con ocasión de efectuar la partición hereditaria y filiación. Un nuevo impulso se pretende dar a la institución, en este caso de gran trascendencia, si prospera cierta iniciativa legislativa acerca de la modificación de la normativa sobre la discapacidad, surgida, en lo esencial, con la finalidad de un mayor acomodo normativo a los postulados proclamados en la Convención Internacional de Naciones Unidas sobre los derechos de las personas con discapacidad de 13 de diciembre de 2006. Pues bien, concebido el defensor judicial, bajo dicha iniciativa legislativa, como una concreta medida de apoyo, aunque temporal, a favor del discapacitado, la figura del defensor judicial dejaría de ser concebida necesariamente como una institución supletoria de otros regímenes de guarda, al revestir en estos casos la consideración de una institución autónoma. Se trata, indudablemente de un importante cambio cualitativo en la figura del defensor judicial. | One of the main aspects that should be highlighted from the institution of the judicial defender is the great development experienced by its regulation in relation to its scope of intervention. The original action sphere of the judicial defender, restricted to parental authority, was expanded to the regimes of guardianship and curatorship by Act 13/1983 24th October, which amended the Spanish Civil Code. This regulation has kept unchanged until Act 15/2015, 2nd July, of Voluntary Jurisdiction, provoking with its adoption substantial incidents in the functioning of the institution and certain dysfunctions with the normative framework that the Civil Code provides. Regarding his praxis, the intervention based on a conflict of interests is analysed with the purpose of obtaining the corresponding action criteria followed by the Supreme Court and the Directorate General of Registries and the Notary. In this regard, conflicts related to the partition of a succession and filiation stand out. If a certain legislative initiative for the amendment of the regulations on disability, arising, in essence, with the purpose of a greater normative accommodation to the United Nations International Convention on the Rights of Persons with Disabilities, 13th December 2006, catch on, a new impulse will be given to the institution, in this case of great transcendence. Then, conceived the judicial defender, under this legislative initiative, as a concrete measure of support, albeit temporary, in favour of the disabled person, the institution of the judicial defender would cease to be necessarily conceived as a supplementary institution of other guardianship regimes, because if that initiative is successful, the judicial defender would be an autonomous one. Undoubtedly, it is an important qualitative change in the judicial defender institution.
