| The purpose of this study is to denounce the current situation regarding surrogate motherhood and to advocate an urgent reform of it. The various interpretative criteria maintained in administrative and judicial headquarters and between the civil courts and those of the social order, are generating a great legal insecurity. The Supreme Court doctrine recognizing the right to maternity and paternity benefits in these cases (both for the workforce and for the statutory and autonomous staff) has led the Social Security to recognize gestation by substitution as a protected situation for the purposes of such benefits, dictate the relevant interpretative criteria. But the regulation of these issues can not rest indefinitely on the jurisprudential and administrative criteria dictated to date for specific cases. The intervention of the legislator must put an end to the discriminatory situations to which the application of jurisprudential doctrine is giving rise. |
