La conservación e integridad de las fuentes de prueba. La cadena de custodia: especial referencia a la custodia de imágenes

Abstract

La cadena de custodia es el iter que conduce de la fuente de prueba al hecho probado. En consecuencia, su rectitud, suficiencia y claridad constituyen elementos fundamentales para garantizar que la fuente de prueba sobre la que se va a practicar la prueba es la misma que se encontró o preconstituyó, pues, de lo contrario, nos encontraremos ante su expulsión del proceso. En el presente trabajo se realiza un repaso a los elementos primordiales que integran la cadena de custodia, partiendo de las definiciones que se consideran más esenciales, pasando por el examen de los preceptos que podrían haberse recogido en nuestra norma por considerarse completos y adecuados para finalizar analizando todo el proceso de custodia, los sujetos intervinientes en el mismo y qué sucede cuando se produce una ruptura de esta.

The chain of custody is the iter that drives a specific piece of evidence from the moment it has been gathered by investigators to the criminal trial. Consequently, its accuracy, identity and security conditions constitute a key elements in order to guarantee that that very piece of evidence presented in trial is exactly the same one that was gathered, so that the evidence is unaltered, since otherwise, the evidence must be suppress from the process. In this article the author examines the main elements of the chain of custody, from its most essential meaning and definition of the term, but also having into account the provisions that could have been included in our law, considering the best way to proceed with. Finally, the article examines the complete custody process, the forensic investigators involved in it and what happens when a break of the chain occurs.
