La garantía de disponibilidad de recursos hídricos en la aprobación definitiva de los planes urbanísticos

Abstract: 
Como la normativa estatal en materia de aguas y la normativa territorial y urbanística autonómica exigen la necesidad de acreditar la suficiencia y disponibilidad de recursos hídricos suficientes para desarrollar actuaciones urbanísticas los procesos de reclasificación de suelo o la decisión de implantar nuevos desarrollos urbanísticos deben elaborarse según el uso sostenible de los recursos hídricos naturales. El problema se plantea cuando la Administración autonómica pretende la aprobación definitiva del instrumento de planeamiento en ausencia de acreditación favorable, o con acreditación desfavorable o con acreditación favorable de suficiencia de recursos hídricos emitida por una entidad colaboradora del suministro. En ese contexto, este artículo viene a analizar tanto la normativa como la interpretación jurisprudencial de la legislación española y valenciana en torno a la emisión del informe de la Confederación hidrográfica sobre la suficiencia de recursos hídricos con carácter previo a  la aprobación de un plan urbanístico.
The state water regulation and the territorial and urban development autonomous regulation demand the need to accredit the sufficiency and availability of water sufficient resources to develop urban development actions, then the processes of reclassification of soil or the decision to implant new urban developments must weight with the sustainable use of the water natural resources,. The problem appears when the Autonomous Administration claims the definitive approval of the instrument of planning in absence of favorable accreditation, or with unfavorable accreditation or with favorable accreditation of sufficiency of water resources issued by an entity collaborator. In this context, this article comes to analyze both the regulation and the jurisprudential interpretation of the Spanish and Valencian legislation concerning the emission of the report of the Hydrographic Federation on the sufficiency of water resources before of the approval of an urban development plan.
