El nuevo juicio posesorio de recuperación de la vivienda ocupada de manera ilícita

Abstract

As a consequence of the exponential increase of illegal occupations of property in Spain, this paper aims at conducting a detailed study of the new regulation set in the Law 5/2018, of 11 of June, which reforms the former Law 1/2000, of 7th of January, of Civil Procedure, in relation to the illegal occupation of property. As such, this study highlights the benefits of the new regulation and also the prima facie shortcomings, formulating in this regard a lege ferenda proposal in order to lay down some ideas that would possibly improve the management of this this special process.
