Internet y contrato de juego. El juego on line y la regulación del contrato de juego y apuesta en el Derecho español

Abstract

El juego y la apuesta siempre han tenido interés para el Derecho y, particularmente, para el Derecho Civil. Los Códigos civiles han regulado el contrato de juego y apuesta atendiendo a la realidad de la época de la codificación. Internet ha supuesto una auténtica revolución en muchas materias del Derecho Civil y muy especialmente, en la concepción y práctica del juego y la apuesta. El juego y apuesta on line ha hecho necesaria una nueva regulación jurídica conforme a la realidad actual. La mencionada regulación tiene un importante componente privado, como es el contrato de juego y apuesta. El presente trabajo aborda el impacto de internet en los juegos y apuestas, el juego on line y la regulación del contrato de juego y apuesta en el Derecho español, interpretando el Código civil conforme a la Ley de Regulación del Juego española y su normativa de desarrollo.

Gambling and betting always have had interest for the Law and, particularly, for the Civil law. The civil Codes have regulated the gambling and betting contract attending to the reality of the epoch of the codification. Internet has been an authentic revolution in many matters of the Civil law and very specially in the conception and practice of gambling and betting. The on-line gambling and betting has made necessary a new juridical regulation according to the current reality. The above mentioned regulation has an important private component, like is the gambling and betting contract. The present work approaches the impact of internet on gambling and betting, the on line gaming and the regulation of the gambling and betting contract in Spanish Law, interpreting the civil Code according to the Spanish Law of Game and Bett and its implementing regulations.
