Constitucionalismo feminista: evolución de los derechos fundamentales en el constitucionalismo oficial

Abstract

La perspectiva de género como un método de investigación integral permite comprender las dimensiones del derecho que se han obviado, especialmente, en el constitucionalismo androcéntrico. La existencia de un constitucionalismo feminista nacido en el seno de la Ilustración y su influencia en la gestación del Estado constitucional es el tema del presente estudio. En éste se pone énfasis en las Declaraciones de De Gouge 1791 y de Haití 1804 que recogen la influencia del feminismo ilustrado y los valores liberales.

The gender perspective as an integral research method permits the understanding of those dimensions of Law that have been obviated, especially in androcentric constitutionalism. The existence of a feminist constitutionalism, fruit of the Illustration, and its influence upon the makings of the constitutional State, is the theme of this study. It puts emphasis on the Declarations of De Gouge (1791) and of Haiti (1804) which embodied the influence of illustrated feminism and liberal values.
