40 años de justicia constitucional en España

Abstract

Este artículo reflexiona sobre el papel desempeñado por el Tribunal Constitucional español en los 40 años de democracia de este país. Para ello se presenta el diseño institucional que de este órgano hizo la Constitución de 1978 y las distintas funciones que le fueron encomendadas, tanto por la Constitución como por la legislación posterior. El artículo analiza críticamente cómo se han desempeñado en la práctica estas funciones, señalando los distintos desafíos que se le han planteado a este órgano, así como las respuestas del ordenamiento jurídico ante los mismos. El artículo finaliza con una evaluación de la situación del Tribunal Constitucional en la actualidad.

This paper deals with the role played by the Spanish Constitutional Court in the 40 years of democracy in this country. Thus, the article presents the institutional design drawn by the Spanish Constitution of 1978 and the different functions that were entrusted to it, both by the Constitution and by subsequent legislation. The article intends to analyze how these functions have been carried out in practice, pointing out the different challenges that have been presented to this Court, as well as the answers given by the legal system to them. The article ends with an evaluation of the situation of the Constitutional Court at present.
